The agreement

These Terms govern your use of Owner IQ, including owner-iq.com, the Owner IQ app, and any data you get from them. By creating an account, starting a plan, or using Owner IQ, you agree to these Terms and to our Privacy Policy.

If you use Owner IQ for a company, you confirm you can bind that company to these Terms. You must be at least 18 and use Owner IQ for business purposes.

Your account

Give us accurate account information and keep your sign-in to yourself. Each login is for one person. You are responsible for activity under your account and for telling us promptly if you think someone else has used it.

Plans, billing and cancellation

Plans, prices and monthly allowances are shown on our pricing page and at checkout. The terms you accept at checkout control your purchase.

Plans renew every month until cancelled, and you authorize our payment processor to charge your payment method on each renewal. If a payment fails we may pause access until it is resolved. You can cancel at any time; your plan stays active through the end of the month you paid for. Unless the law requires otherwise or we agree in writing, payments are not refundable.

If we change a price, the new price applies from your next billing month after we tell you.

How you may use Owner IQ data

While your plan is active, we give you a limited, non-exclusive, non-transferable and revocable license to search and view Owner IQ, and to use the records you export for your own company's business-to-business sales and marketing.

Records you exported during an active plan may stay in your own systems after it ends, as long as you keep following these Terms and honor any request not to be contacted.

What you may not do

• Resell, license, publish or otherwise give Owner IQ data to anyone outside your company.
• Use Owner IQ data to build, improve or check another database or data product, or to train a model for that purpose.
• Scrape, crawl or extract data by automated means or repeated queries, beyond the exports Owner IQ provides, or work around search and export limits.
• Share a login or let anyone else use your access.
• Use Owner IQ to make decisions about anyone's eligibility for credit, insurance, employment or housing, or for any purpose covered by the Fair Credit Reporting Act.
• Contact people for personal, family or household purposes, or to harass, stalk, threaten or unlawfully discriminate against anyone.
• Interfere with the security or operation of Owner IQ, or use it in any way that breaks the law or someone else's rights.

Your outreach and the law

You are responsible for how you contact the people and businesses you find in Owner IQ. That includes the Telephone Consumer Protection Act, the Telemarketing Sales Rule, state telemarketing laws, the National Do Not Call Registry and state lists, calling-hour and caller-ID rules, the CAN-SPAM Act, and privacy laws.

Owner IQ labels which numbers are cell phones, so you know where stricter rules on automated calls and texts apply. Owner IQ does not check numbers against the National Do Not Call Registry for you. Honor every request not to be contacted, and stop using a person's information if we tell you it was removed at their request.

Accuracy

Owner IQ combines many sources that change all the time. Records can be incomplete, out of date or wrong, and labels like “owner,” “cell,” “revenue” or “active” are our best assessment, not a guarantee. Check anything important before you rely on it. We may correct, update, merge or remove records at any time.

Your content

Lists, notes and other content you create or upload in Owner IQ stay yours. You let us host and process them only to provide the service to you. We do not add your content to the Owner IQ database or share it with other customers without your permission.

What belongs to us

Owner IQ, including the database as compiled, its selection, arrangement and merged records, our software, and the Owner IQ name and marks, belongs to us and our licensors. Apart from the license in these Terms, you receive no rights in it.

If you send us ideas or feedback, we may use them freely and without obligation to you.

Other services

Owner IQ works alongside services we do not control, such as sign-in providers, payment processors and the tools you send records to. Their own terms apply to them, and we are not responsible for their availability or their actions.

Suspension and termination

You can stop using Owner IQ at any time. We may suspend or end your access if you break these Terms, misuse the data, create a security risk, do not pay, or if the law requires it.

The sections on restrictions, compliance, ownership, disclaimers, liability, indemnity and disputes continue after your access ends.

Disclaimers

OWNER IQ IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT THE LAW ALLOWS, WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT AND ACCURACY. WE DO NOT PROMISE THAT ANY RECORD IS COMPLETE OR CORRECT, THAT ANY NUMBER REACHES THE PERSON LISTED, OR ANY RESULT FROM YOUR OUTREACH. OWNER IQ IS NOT LEGAL ADVICE.

Limitation of liability

TO THE FULLEST EXTENT THE LAW ALLOWS, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO OWNER IQ IS LIMITED TO THE GREATER OF WHAT YOU PAID US IN THE THREE MONTHS BEFORE THE CLAIM AROSE, OR US$100.

Indemnity

You will defend and indemnify Owner IQ and its people against third-party claims, fines and costs arising from your outreach, your use of Owner IQ data, or your breach of these Terms or the law.

Disputes and governing law

Before starting a formal dispute, write to us at support@owner-iq.com and give us 30 days to try to resolve it. Unless a signed agreement with us says otherwise, these Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-law rules, and any dispute will be heard in the state or federal courts in Cook County, Illinois.

The rest

You may not transfer these Terms without our consent; we may transfer them as part of a reorganization, financing, merger or sale. If a provision is unenforceable, the rest still applies, and not enforcing a provision is not a waiver of it. These Terms, our Privacy Policy, your checkout terms and any signed order form are the entire agreement about Owner IQ.

We may update these Terms. The effective date at the top shows the current version; we will give notice of material changes, and continuing to use Owner IQ after they take effect means you accept them.
